TERMS & CONDITIONS

These Terms and Conditions govern access to and use of hotbyscience.com, care.hotbyscience.com, related Hot by Science applications and portals (the “Sites”), and the products and nonclinical services offered through the Hot by Science platform. Hot by Science Inc. is referred to as “we,” “us,” or “our.” These Terms do not replace the separate terms, informed consents, notices, or professional obligations of a licensed healthcare provider, laboratory, or pharmacy.

1. Acceptance of Terms

By creating an account, accessing the Sites, clicking to accept these Terms, or placing an order, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Sites. You must be at least 18 years old and legally able to enter into a binding contract. If you use the Sites for an organization, you represent that you are authorized to bind that organization.

2. Company and Services

Hot by Science Inc. operates the account system and provides technology, administrative, membership, customer-support, and other nonclinical services associated with the Hot by Science platform. It also displays educational findings from the HBS observational research study. Hot by Science Inc. is not a healthcare provider and does not practice medicine.

Licensed healthcare providers, medical groups, laboratories, pharmacies, payment processors, shipping companies, and other third parties provide their own services. Their professional and contractual responsibilities remain with the applicable service provider. The applicable checkout page or separate agreement will identify the entity selling the product or service. Use of the Hot by Science platform does not make Hot by Science Inc. responsible for another entity's professional obligations.

3. Hot by Science Account

Hot by Science Inc. administers the account and authentication system for the Sites. Your account enables access to the Hot by Science features and services available to you. Access to clinical information is limited according to the applicable user role, authorization, service arrangement, and law. Products and services are provided by the entity identified at checkout or in the applicable service agreement. An account or platform membership does not replace any separate consent or agreement required by a licensed provider, laboratory, or pharmacy.

4. Medical Services and Independent Providers

The Sites may help you request or receive services from independent licensed healthcare providers. Providers alone decide whether to accept you as a patient, which tests or evaluations are appropriate, whether a prescription is medically indicated, and what treatment to recommend. Hot by Science Inc. does not direct or override clinical judgment.

Creating an account, buying a membership, completing a questionnaire, or paying a platform fee does not create a clinician-patient relationship with Hot by Science Inc. and does not guarantee that a provider will accept you, order a test, diagnose a condition, or issue or renew a prescription. A clinician-patient relationship arises only with the provider and only under the provider's applicable terms and law.

Medical services are available only when you are physically located in a jurisdiction where the provider is authorized to practice and where the service is lawful. You must accurately state your location at each encounter. Separate telehealth consent, treatment consent, financial terms, and privacy notices may apply.

5. No Emergency or Primary Care Service

The Sites are not an emergency service and are not a substitute for an ongoing relationship with a primary care provider. Do not use the Sites for urgent or emergency needs. If you believe you are experiencing a medical emergency, call 911 or go to the nearest emergency department. Do not delay care because of information or a message on the Sites.

6. Your Health and Account Information

You must provide complete, current, and accurate information, including your identity, location, medical history, medications, allergies, pregnancy or breastfeeding status, laboratory information, and other facts requested by a provider. You must promptly correct material changes. A provider may decline or discontinue services when information is incomplete, inaccurate, or inconsistent, or when remote care is not appropriate.

You may not create an account for another adult, submit another person's health information, or permit another person to use your account unless the Sites expressly support an authorized representative and all required permissions have been completed.

7. Laboratory Services

Laboratory testing may require an order from a licensed provider and is performed by independent laboratories. Collection availability, turnaround time, specimen integrity, reference ranges, and result accuracy are controlled by the laboratory. Delays or repeat collection may occur. A result displayed by the Sites is not, by itself, a diagnosis. Contact the ordering provider to interpret results and determine appropriate follow-up.

8. Prescriptions and Pharmacies

Only a licensed provider may prescribe medication. The provider may require additional information, examinations, monitoring, or laboratory testing, and may decline, change, or discontinue a prescription. Prescriptions are filled by independent licensed pharmacies under their own terms and professional duties. Product availability, formulation, shipping, refills, substitutions, and pricing may change. Compounded medications are not FDA-approved. The United States Food and Drug Administration does not review compounded medications for safety, effectiveness, or quality before they are marketed.

9. Supplements and General Information

Supplements and educational content are not intended to diagnose, treat, cure, or prevent disease and do not replace medical advice. Review product labels and allergen information before use. Ask a qualified healthcare professional before using a supplement if you are pregnant, breastfeeding, have a medical condition, or take medications. Results vary, and no outcome is guaranteed.

10. Observational Research Findings and Participation

Hot by Science shares educational findings from an IRB-approved observational study that collects biological data and self-reported experiences from people using peptides and small molecules. Findings may include self-reported outcomes, such as perceived benefits, no perceived benefit, and adverse experiences, and may be grouped by biological profile. These reports describe participant experiences and observed associations; they do not establish that a substance caused an outcome or that it is safe or effective. Findings may be affected by selection bias, recall bias, other treatments, small sample sizes, and differences between participants. Similar biological profiles do not establish that another person will have the same experience. Findings are educational and are not a diagnosis, prescription, care plan, or recommendation to obtain, start, continue, or change use of a substance. Where findings concern an unapproved substance or use, the accompanying content identifies that status and relevant evidence limitations. IRB approval concerns oversight of the study; it is not FDA approval of a substance or endorsement of its clinical use.

Viewing research findings, creating an account, or purchasing a membership does not enroll you in the study. Participation is optional and governed by a separate research consent and, when applicable, authorization describing the study, investigator, IRB oversight, data uses, and your rights. People who already use peptides or small molecules may review study information and eligibility requirements before deciding whether to participate. An invitation to participate does not recommend starting or changing use of a substance. Declining research participation will not by itself prevent access to otherwise available educational content or services. Any use of personal information to select findings for display is governed by the Privacy Policy and applicable permissions; it is distinct from enrollment in the study.

11. Orders Pricing and Taxes

Prices, included services, taxes, shipping charges, and recurring charges are shown at checkout or in an order form. You authorize the identified seller and its payment processor to charge the payment method you provide. You represent that you are authorized to use that payment method. Prices may change prospectively. A price change does not affect an accepted one-time order, except where correction of an obvious error is permitted by law.

A provider, laboratory, pharmacy, or other third party may charge separately. Unless the checkout page expressly says otherwise, Hot by Science Inc. does not submit claims to insurance and does not guarantee reimbursement.

12. Subscriptions and Automatic Renewal

If you purchase a subscription, the checkout page will state the renewal interval, amount or method for determining the amount, minimum term if any, and how to cancel. By affirmatively enrolling, you authorize recurring charges until you cancel. We will provide the confirmations and renewal or price-change notices required by law.

You may cancel through the account billing settings or another method identified at checkout. Cancellation stops future renewals and does not retroactively refund charges already incurred unless the applicable refund policy or law requires a refund. Ending a platform subscription does not automatically cancel an order already sent to a laboratory or pharmacy or a provider appointment.

13. Cancellations Returns and Refunds

The cancellation, return, and refund terms displayed at checkout apply to the applicable order. Custom prepared or dispensed medications, laboratory services after collection or processing begins, digital services already delivered, and opened or temperature-sensitive products may be nonreturnable or nonrefundable to the extent permitted by law. Nothing in these Terms limits a right that cannot lawfully be waived. Contact support promptly if an item arrives damaged, incorrect, or materially inconsistent with the order.

14. Shipping and Delivery

Shipping dates are estimates. Delivery may be affected by carrier delays, weather, address errors, product availability, temperature excursions, or legal restrictions. You are responsible for providing an accurate deliverable address and promptly retrieving packages. Risk of loss and title pass as stated at checkout and under applicable law. Do not use a damaged, compromised, improperly stored, or temperature-sensitive item whose integrity is in doubt.

15. Account Security

Keep your credentials confidential, use reasonable security measures, and promptly notify support@hotbyscience.com of suspected unauthorized access. You are responsible for activity through your account until you notify us, except to the extent law provides otherwise. We may require identity verification, reset credentials, revoke sessions, or temporarily restrict access to protect users and the Sites.

16. Acceptable Use

You may not:

• violate law, another person's rights, or these Terms;
• submit false, misleading, stolen, or unauthorized information;
• gain or attempt to gain unauthorized access to an account, system, record, or network;
• introduce malware, interfere with security, probe vulnerabilities without written permission, scrape protected areas, or impose an unreasonable load on the Sites;
• copy, reverse engineer, modify, distribute, or commercially exploit the Sites except as law expressly permits;
• use Site content to train a competing model or service without written permission.

17. Intellectual Property and Limited License

The Sites and their software, text, graphics, trademarks, designs, and other content are owned by Hot by Science Inc. or their licensors and are protected by intellectual-property law. Subject to these Terms, Hot by Science Inc. grants you a personal, limited, revocable, nonexclusive, nontransferable license to use the Sites for their intended purpose. No other rights are granted. Feedback you voluntarily provide may be used without restriction or compensation.

18. Third Party Services

The Sites may link to or integrate with services operated by providers, laboratories, pharmacies, payment processors, carriers, analytics vendors, or other third parties. Their terms and privacy practices apply to their services. We are not responsible for a third party's independent acts, omissions, content, availability, or security, except where law provides otherwise.

19. Electronic Communications

You consent to receive transaction, security, account, and service communications electronically. You may withdraw consent to optional marketing communications using the unsubscribe method provided. Consent to marketing is not a condition of purchasing goods or services. Telephone and text communications may be subject to a separate consent. Electronic communications are not appropriate for emergencies.

20. Privacy

The Privacy Policy explains how Hot by Science Inc. handles personal information. Licensed providers and other third parties may provide separate notices. If a provider's Notice of Privacy Practices applies to protected health information, that notice governs the provider's use and disclosure of that information to the extent required by law.

21. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITES AND NONCLINICAL SERVICES ARE PROVIDED AS IS AND AS AVAILABLE. HOT BY SCIENCE INC. DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON INFRINGEMENT. IT DOES NOT WARRANT THAT THE SITES WILL BE UNINTERRUPTED, ERROR FREE, SECURE, OR SUITABLE FOR A PARTICULAR RESULT. THIS SECTION DOES NOT DISCLAIM A WARRANTY THAT CANNOT LAWFULLY BE DISCLAIMED AND DOES NOT GOVERN A LICENSED PROVIDER'S PROFESSIONAL STANDARD OF CARE.

22. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOT BY SCIENCE INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM THE SITES OR NONCLINICAL SERVICES, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF HOT BY SCIENCE INC. AND THE OTHER PARTIES IDENTIFIED IN THIS SECTION FOR CLAIMS ARISING FROM THE SITES OR NONCLINICAL SERVICES WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS OR THE AMOUNT YOU PAID TO HOT BY SCIENCE INC. FOR THE PRODUCT OR NONCLINICAL SERVICE GIVING RISE TO THE CLAIM DURING THE SIX MONTHS BEFORE THE EVENT. THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED, TO ANY PROTECTED PARTY'S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OR TO THE PROFESSIONAL LIABILITY OF A LICENSED HEALTHCARE PROVIDER.

23. Indemnification

To the extent permitted by law, you will defend, indemnify, and hold harmless Hot by Science Inc. from third-party claims, damages, and reasonable costs arising from your unlawful use of the Sites or material breach of these Terms. This obligation does not apply to the extent a claim results from Hot by Science Inc.'s negligence, willful misconduct, or violation of law.

24. Suspension and Termination

You may stop using the Sites at any time. We may suspend or terminate access when reasonably necessary to address nonpayment, fraud, security risk, unlawful conduct, a material breach of these Terms, or legal or regulatory requirements. When practicable, we will provide notice. Termination of Site access does not erase amounts already due or records that must be retained, and it does not by itself terminate a clinician-patient relationship. Contact the provider regarding continuity of care and access to medical records.

25. Changes to the Sites and Terms

We may change the Sites and these Terms. The revised Terms will state the updated date. If a change is material, we will provide notice by email, through the account, or by another reasonable method before the change takes effect when required by law. Changes apply prospectively. Continuing to use the Sites after the effective date constitutes acceptance, except when law requires separate consent.

26. Governing Law and Venue

California law governs these Terms without regard to conflict-of-law principles, except that federal law governs issues within its scope. Any dispute between you and Hot by Science Inc. arising from these Terms or the Sites must be brought in a state or federal court located in Los Angeles County, California, and each party consents to that court's jurisdiction. This section does not deprive a consumer of a nonwaivable protection of the law of the consumer's state of residence and does not govern a separate dispute with a licensed provider, laboratory, or pharmacy.

27. General Terms

These Terms, the Privacy Policy, and the terms presented for a specific order constitute the agreement between you and Hot by Science Inc. concerning the Sites and the products or nonclinical services it provides. Separate agreements govern services provided by other entities. If order-specific terms conflict with these Terms, the order-specific terms control for that transaction. If a provision is unenforceable, it will be enforced to the greatest extent permitted and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign these Terms without written consent; Hot by Science Inc. may assign its rights and obligations in connection with a merger, financing, reorganization, or sale of the relevant business, subject to applicable law.
